These Terms of Service ("Terms") govern your access to and use of the websites, APIs, and services (collectively, the "Services") provided by Oculix LLC ("Oculix," "we," "us," or "our"). By using the Services, you agree to these Terms.
You are responsible for safeguarding any API key issued to you and for all activity that occurs under it. Notify us immediately at info@oculix.net if you believe a key has been compromised.
Free tier access is subject to the quota limits published on our pricing pages at the time of signup and may be adjusted, suspended, or discontinued at our discretion with 30 days' notice where practicable.
You agree not to use the Services to:
PropDesc-AI screens listings against fair housing rules, but you are responsible for reviewing every listing before you publish it. PropDesc-AI is a drafting aid. It writes listing text only from the property facts and features you provide, and it screens drafts for language commonly associated with fair housing problems. These checks reduce risk but do not guarantee that any text complies with the Fair Housing Act or with state or local law, and nothing the service produces is legal advice.
You are responsible for reviewing every listing before you publish it and for ensuring that your advertising complies with applicable fair housing, anti-discrimination and advertising laws, including any rules that apply to your market or to age-restricted housing. You agree not to use the service to describe, target, include or exclude people based on race, color, religion, sex, national origin, familial status, disability, age, source of income, or any other characteristic protected by law, and not to attempt to bypass the service's screening. Oculix may decline or block requests that appear to do so. Housing for older persons (such as 55+ communities) has legal exceptions that the service does not handle; it will not generate listings for it.
Paid plans are billed in advance on a monthly basis through our payment processor, Stripe. Fees are non-refundable except as required by law or as stated in a signed order form for audit and review services (Section 4A); contact info@oculix.net with any billing questions.
Fixed-fee audit and review services are sold under a signed order form that states the scope, fee, delivery time and remedy. The order form controls over these Terms for that engagement. The services analyze metadata you export and send; we do not access or change your systems, and you decide, test and implement any recommendation. Reports are estimates based on the data you supply, are not exhaustive, and do not guarantee savings, performance or compliance. They are not an audit opinion, security assessment or legal advice. You must not send application data, personal data, secrets or payment-card data. How we handle your files is described in Section 3A of our Privacy Policy.
You retain all rights to content you submit to the Services. We retain all rights to the Services themselves, including underlying software, models, and infrastructure.
We aim for high availability but do not guarantee the Services will be uninterrupted or error-free. Current operational status is published at oculix.io/status. We do not currently offer a formal uptime SLA.
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCULIX LLC'S TOTAL LIABILITY ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100 IF YOU ARE ON A FREE TIER. FOR AUDIT AND REVIEW SERVICES, THE LIMIT IS THE FEES PAID UNDER THE APPLICABLE ORDER FORM.
We may suspend or terminate your access to the Services for violation of these Terms or the Acceptable Use section above, with or without notice as circumstances warrant.
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles.
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
